Netherurd Garden House – Booking Terms & Conditions

These Terms & Conditions (“Terms”) apply to all accommodation bookings made with Red Trousers LTD trading as Netherurd Garden House (“we”, “us”, “our”). By making a booking, the guest (“you”, “your”) agrees to be bound by these Terms.


1. Booking, Deposits & Payments

1.1 Deposits for Advance Bookings

  • Bookings made more than 60 days prior to the check-in date require a 30% non-refundable deposit to secure the reservation.
  • A booking is not confirmed until the deposit has been received.

1.2 Balance Payments

  • The outstanding balance is due 30 days before the check-in date.
  • If the balance is not paid by this date, we reserve the right to cancel the booking and retain the deposit.

1.3 Bookings Within 60 Days

  • Bookings made 60 days or fewer prior to check-in must be paid in full at the time of booking.

1.4 Payment Methods

Guests may pay using:

  • Bank transfer (details provided upon request)
  • Secure payment link
  • Debit or credit card over the phone

2. Cancellations & Refunds

2.1 Deposits

  • All deposits are strictly non-refundable, regardless of the reason for cancellation.

2.2 Cancellations After Full Payment

  • If you cancel 14 days or more before the check-in date, you are eligible for a refund of the full amount paid, minus the non-refundable deposit.
  • Cancellations made fewer than 14 days before check-in are non-refundable.

2.3 Cancellations by Us

  • In the unlikely event that we must cancel your booking (e.g., due to unforeseen circumstances or property issues), you will receive a full refund, including your deposit. We are not liable for any additional costs incurred by the guest.

3. Check-In, Check-Out & Guest Responsibilities

3.1 Check-In/Out Times

  • Check-in and check-out times will be provided in your booking confirmation.
  • Early check-in or late check-out may be available by prior agreement and may incur additional charges.

3.2 Guest Numbers

  • The property may only be occupied by the number of guests stated at the time of booking.
  • Additional overnight guests are not permitted without prior approval.

3.3 Use of the Property

  • The property is to be used solely for respite, holidays, accessible accommodation, self-catering accommodation, emergency care and must not be used for parties, events, or commercial activities unless otherwise agreed in writing.

4. Damage, Loss & Cleanliness

4.1 Damage & Excessive Wear

  • Guests are responsible for the property and its contents during their stay.
  • Any damage, breakages, or losses caused by the guest beyond reasonable wear and tear will be chargeable.
  • You must report any damage as soon as possible to avoid additional penalties.

4.2 Additional Cleaning Charges

  • The property must be left in a reasonably clean and tidy condition.
  • Excessive cleaning requirements may incur an additional charge.

5. Smoking Policy

5.1 Smoking Prohibited

  • Smoking is not permitted anywhere inside the building or within the grounds of Netherurd Garden House.
  • This includes the use of cigarettes, e-cigarettes, vapes, cigars, and all smoking paraphernalia.

5.2 Smoking Fine

  • Smoking inside the property will result in a cleaning and remediation fine, the amount of which will be determined based on the extent of the impact.

6. Pets

  • Pets are only allowed if expressly stated in the booking confirmation.
  • Additional charges and conditions may apply.

7. Liability

7.1 Personal Property

  • We are not responsible for the loss of, or damage to, any personal belongings brought onto the premises.

7.2 Injury

  • Guests use the property and grounds at their own risk.
  • We accept no liability for accidents, injuries, or illnesses that occur during your stay, except where caused by our negligence.

8. Force Majeure

We are not liable for failure to provide the accommodation or services due to events beyond our reasonable control, including but not limited to natural disasters, government restrictions, power outages, or other unforeseen circumstances.


9. Governing Law

These Terms & Conditions are governed by the laws of Scotland. Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
